To this end both Stud Dog owner and Bitch owner agree that the following are part of the contract. Bitch 1. Bitch must be registered by the American Kennel Club and be over 24 months of age. 2. Bitch may have no disqualifying faults per the Breed Standard for Great Danes and all genetic and/or health problems which exist or have existed in the Bitch have been disclosed to the Stud Dog owner. 3. Bitch must have good temperament and be available to Stud Dog owner for examination. 4. Bitch owner must provide Stud Dog owner with Bitch's four (4) generation pedigree. 5. Bitch owner MUST provide Stud Dog owner with current brucellosos results performed within fourteen (14) days of the expected breeding. 6. Bitch owner warrants that Bitch has not been exposed to any other Stud Dog from the start of her heat cycle. Stud Dog 1. A Stud Fee of $_______ shall be payable in full prior to the first mating by cash or certified check. A $100 discount to bitches with CHIC #'s. 2. Bitchs must have OFA or Penn Hip certification, and it is preferred that OFA thyroid and OFA cardiac are also done. 3. Bitch owner is responsible for any and all fees associated with the breeding, including but not limited to veterinary services, shipping fees, ovulation timing tests, and other fees. 4. Stud Dog owner guarantees that the Bitch whelps two (2) live puppies that live to one (1) week of age. If Bitch fails to whelp or whelps less than two (2) live puppies, the owner of the Bitch must notify the Stud Dog owner within seven (7) days of the expected whelp date. In these cases, the Stud Dog owner will provide one (1) repeat stud service to that same Bitch at no additional charge. If no pregnancy occurs with the return stud service, then the obligations of both parties are terminated. Any substitute Bitch must be approved in the sole discretion of the Stud Dog owner. 5. The stud fee shall not be refunded, in whole or in part, for any reason. Puppies 1. Bitch owner agrees to sell any puppy of �pet-quality� or with a disqualifying fault on an AKC limited registration and spay/neuter contract. 2. Bitch owner agrees to assume responsibility for any resultant puppies for their lifetime and agrees to accept any puppy that is returned. 3. Bitch owner agrees not to knowingly sell a puppy to a pet store, animal wholesaler, puppy mill, or broker. Bitch owner also agrees puppies will not be given to the Humane Society or dog pound. Other 1. Stud Dog owner reserves the right to refuse to breed any bitch that is aggressive to any person while attempting to breed naturally or artificially. In this case the full stud fee less $100.00 for expenses will be refunded. 2. The Stud Dog provides a service and Bitch owner will be held liable for any loss of future stud service due to Bitch owner�s concealment of health problems. 3. In breeding animals these is always a risk that one may be injured during the process. Bitch owner agrees to hold the Stud Dog owner harmless from any liability and/or damage. In addition, the Bitch owner understands that the Stud Dog owner accepts no liability for the actions of this Bitch while in their care, including but not limited to personal injury or property damage. 4. It is specifically agreed that Stud Dog owner is not required to sign the application for registration of a resulting litter until such time as all expenses and stud fees are paid and all conditions of this contract are fulfilled. 5. Chilled Semen Breeding: It is the bitch owner�s responsibility to make shipping arrangements, pay semen collection, preparation and shipping expenses to the collection facility. We are not responsible for chilled semen once it has left the collection facility. Any further agreement between the parties is set forth below: This contract contains the entire agreement of the parties and shall be construed and enforced in accordance with the laws of the State of Kentucky. Both parties stipulate that there are no other agreements other than those set forth in this document. Any legal action filed by either party in an effort to enforce the terms of this contract, will be filed Hardin County Kentucky. If any legal action occurs, the prevailing party will be entitled to recover reasonable costs and attorney�s fees. Each party acknowledges that they have read and understand the terms and conditions of the Stud Service Contract and have voluntarily entered into and executed this agreement.
